Terms and Conditions

1. Glossary

“Zestify Media Ltd” means Zestify Media Ltd, Registered Company Number: 06957790.

“we” in all cases refers to Zestify Media Ltd. “you” in all cases refers to the customer.

2. Our Agreement

This legal agreement applies to all purchases made by you and sets out the Terms and Conditions when placing an order via www.zestify.tv (the site) or our Orderline (Telephone).

Zestify Media Ltd reserves the right to make changes to its policies and Terms and Conditions from time to time, which will become effective upon notification of such changes by us to you. If we make any changes that are materially to your detriment, then you will have the right to terminate this Agreement by giving us notice in writing to take effect no later than 30 days after the date on which such change takes effect. Copies of these Terms and Conditions are available on request and are provided with each new order delivery.

3. Orders

All orders are subject to acceptance by Zestify Media Ltd at our sole discretion, but orders are normally accepted if the products are available and you are based in a country to which we are currently able to sell. All pricing is in UK Pounds and is inclusive of VAT and exclusive of any delivery charges.

Online Orders

You can select items to buy online from our website www.zestify.tv by clicking on the “buy now” button You can carry on shopping or click on the "basket" link in the top right-hand corner of the page to complete your order. This will take you to a summary page of your selected items, where you can review and correct your order details. You are responsible for ensuring the accuracy of the details that you have entered.

We will endeavour to allow uninterrupted access to the website, but access may be suspended, restricted or terminated at any time.

Confirming your Order

To place your order, click on the “Place your order” button. Once your credit/debit card or PayPal information has been entered & submitted, your order will have been requested, and we will confirm receipt of your requested order by email.

Once your order has been accepted, we will confirm by email that your contract to purchase is complete.

Easy Payments

On selected products we may offer you the option of interest free Easy Payments to spread the cost of an order over 3 monthly instalments. (Delivery charges must be paid upfront and are added to your first payment). Easy Payment options are only available to Customers in the UK and Republic of Ireland.

Where this option is available, you must provide your consent to a “Recurring Transaction Agreement” which authorises us, to debit your payment card for the agreed amounts as displayed to you in the payment schedule, the first of which is when your order is dispatched, with any future payments on or soon after the 30th day from when your order was dispatched. Once the entire amount of any monies owed have been settled, your recurring transaction agreement will have ended.

Easy Payment is not available when paying by PayPal.

If we are unable to collect your payment, we will always attempt to contact you by email, post or telephone to advise you of the outstanding payment and to settle your account.

Failure to maintain your payment agreement may result in your details being passed to a debt recovery agency.

4. Delivery

We will deliver the goods to the address specified by you. Once the goods have been delivered, even if they have not been received by you in person, responsibility against damage or loss passes to you.

Your order will be delivered by Royal Mail, Parcel Force or Yodel depending on the product ordered. For items sent on a tracked service, we will provide you with the tracking information in your dispatch confirmation email.

If you are not home, most delivery companies will leave a card or message to indicate if your parcel has been left with a neighbour or in a safe place. Always check the card details or tracking information regarding your delivery, as your parcel may have been delivered or require you to reorganise or collect your parcel from your local depot. If you chose a "Premium Delivery" service we are unable to refund the costs for this service if you decide to return your order. Standard Delivery charges are refunded in accordance with our Cancellation and Returns Policy.

When ordering we will ask you for your email address and mobile phone number and this will be passed to the Delivery agent so that they can send you direct updates for your delivery.

We will not be held responsible for any loss due to circumstances beyond our control for a delay in the delivery of any order. Occasionally a delivery service may be impacted due to weather conditions, an item being lost in transit, or inadvertently delivered to an incorrect address. We will however, aim to resolve any issue as quickly as possible.

If a product is out of stock, you will be notified by Zestify Media Ltd and no payment will be taken until the product is back in stock. You have the right to cancel an order for an out of stock item at any time by contacting Zestify Customer Care.

5. Payment

Zestify Media Ltd accepts PayPal, credit or debit card payments in GB Pounds. If you are paying by credit or debit card, your card will be authorised by your card provider upon submitting your order and payment will only be taken on despatch of the item.
Zestify Media Ltd charges payment cards/PayPal in British Pounds and issues refunds in British Pounds and cannot be responsible for any fluctuations in foreign currency exchange rates.

6. Pricing

The description of the products, price (including VAT, where applicable), cost of delivery and currency in British Pounds are set out in your statement/invoice. Zestify Media Ltd reserves the right to promote the same or similar products with varying offers depending on the advertising route and/or country of sale and/or time. Unless otherwise stated all advertised pricing is in British Pounds.

7. Return and Refund Policy

At Zestify we offer a no quibble 30 day money back guarantee.

Simply contact our Customer Care team for a “RAN” (Returns Authorisation Number) within 30 days of receipt of your order and a member of our team will advise you on how to return your order for a refund.

You must return unwanted items to us at your own cost. We recommend that any items returned to us are sent on a tracked delivery service and that you retain your receipt in case your item is lost or missing, and you need to make a claim against the carrier.

In the unlikely event that you have received a product that you believe to be faulty, please contact our Customer Care team and they will advise you how to return the item. If the product is deemed to be faulty by our testing centre, we will reimburse the P&P for returning the item or arrange an alternative method for the item to be returned to us.

Once we have received your returned item/s or proof of delivery we will arrange a refund to the payment account used at the time that you placed your order within 14 days.

Free Product Offers

If you have ordered a product which includes a free item/s, you must return all items, including any free items received, with your purchased product, to qualify for a refund in accordance with our general Terms & Conditions of sale.

Your legal right to cancel – What the law says

Under the Consumer Rights Act (2015) you have the legal right to cancel your order within 14 days from the date of receipt of the order. Such cancellation notice must be in writing or some other durable medium which is accessible to us and must make clear that you are cancelling your order, and must be either:

In addition to your statutory right to cancel as described above, you must return the item/s to us within 14 days of notifying us of your intention to cancel. We will refund you the product price of your item/s and will refund you any standard P&P provided you have notified us within the statutory 14 days from receipt of your order. We will not refund you for any additional services such as Priority Processing, Gift wrapping.  

Zestify Media Ltd will NOT refund any returned items received outside of our returns policy. In this instance, you may, by contacting us, elect to have such product returned to you, provided that we reserve the right to charge for postage and handling, as well as an administration fee.

All eligible items returned for refund as outlined above must be re-packaged (preferably in the original box) and returned to: Zestify, PO Box 25, Melton Mowbray, LE13 1ZG.

Zestify Media Ltd can only refund returned items where the customer has contacted us for a RAN,  written their account number on the outside of the box, and included a copy of their invoice in the box. Please retain proof of posting.

Nothing in these Terms and Conditions affects your statutory rights as a consumer.

9. Prize Draws and Competitions

All prize draws, and Competitions run and managed by Zestify Media Ltd will be accompanied by separate Terms & Conditions.

10. Intellectual Property & Copyright

Music

Copyright subsists in all recordings issued under the Zestify label. Any unauthorised rental, broadcasting, public performance, copying or recording in any manner whatsoever will constitute infringement of such copyright and will render the infringer liable to an action at law. Public performance or broadcasting licences must be applied for from the licensing institution in the relevant country.

DVD/Video

You may use Zestify Media Ltd products only for individual, personal and non-commercial use and, except as permitted by applicable law, you shall not copy, issue copies, rent, lend, perform, show or broadcast this programme products in public, or make adaptations of the DVDs or Videos.

Copyright laws apply to the products we supply and to the artwork on the packaging. You will be in breach of these laws if you broadcast, copy or perform the material on the products, or copy the artwork, without the copyright owner’s permission.

Registered Trademark

Zestify Media Ltd and the Zestify logo are registered trademarks.

11. Our liability

If you have a valid claim in respect of any of the goods which is based on any defect in the quality or condition of the goods or their failure to meet specification in accordance with this agreement, we shall be entitled to replace the goods (or the faulty part in question) free of charge or, at our sole discretion, refund to you the price of the goods (or a proportionate part of the price).

We shall not be liable to you in connection with this agreement in contract, tort (including negligence) or otherwise for any loss of profit, anticipated savings or data (in each case whether direct or indirect) or any indirect loss.

Our aggregate liability to you in connection with this agreement shall not exceed the value of the goods ordered by you.

Notwithstanding any other provision of these terms and conditions, we will be liable to you without limit for any death or personal injury caused by our negligence and to the extent that liability arises under Part 1 or section 41 of the Consumer Protection Act 1987 and for liability arising from statements made fraudulently by us.

12. General

We shall not be liable to you or in breach of this agreement for delay or failure to perform if the delay or failure is due to a cause beyond our reasonable control.

If we fail to enforce a right under this agreement, that failure will not prevent us from enforcing other rights, or the same type of right on a later occasion.
If any provision of these terms and conditions is held to be unlawful, invalid or unenforceable, that provision shall be deemed severed and the validity and enforceability of the remaining provisions of these terms and conditions shall not be affected.

These terms and conditions shall be governed by and construed in accordance with English law, and we both agree to submit to the non-exclusive jurisdiction of the English courts.
